Legal Question in Employment Law in California

Defamation of character

Can I sue my boss (at a very large and well-known Japanese corp.) for totally lying on my written performance review and accusing me of things which were completely untrue? I attached my rebuttal to her comments to the review and I have tallked to HR about her. I've had 3 other bosses at this company and she's the only boss at this company to ever give me a bad review. I was laid off from one position, and left the other position when both bosses left the company. I've worked at the same corporation for 4 years now, but because of the horrible ratings she gave me the HR dept. says I can't transfer to any other job within the company. In other words, I'll have to leave the company to get away from her and to find a better position. My boss has never said she wants to fire me, and refuses to take any responsibilty for her lack of communication to me.

Re: Defamation of character

No, unless you believe the motivation might be something other than just plain nastiness -- such as sexual or racial discrimination.
