Legal Question in Employment Law in California

Defamation by employee

An employee of a related department is spreading lies about my professional conduct. He sees an opportunity to advance his position by making misleading and false statements about me to my superiors and to my employees. I believe his intent is to get me fired, or at least damage my credibility enough to get me ''out of his way''. Is this harrassment, defamation or something else? How might I approach an effective solution?

Re: Defamation by employee

I would need to have more detailed facts about exactly what your co-employee is saying or doing. From the general description you gave, it is possible that this employee's conduct constitutes slander and/or libel. It is also possible that he or she is engaging in the legal wrong known as "intentional interference with contract" or "interference with an advantageous economic relationship."

It is impossible, however, to provide meaningful guidance about your legal position without more facts. Your first step towards an effective solution may well be to confront this individual face-to-face and find out why he is doing what he is doing and letting him know that you want it to cease and are prepared to take action to force him to stop unless he does so voluntarily.
