Legal Question in Employment Law in California

Department is desolved but is helping us transition to new jobs

I work at a biological research institution affiliated with a big name university. Our lab head is desolving the lab so he can go to industry. They are offering to let us work for a couple more months until we find something else. I'm afraid that they can deny laying us off by doing so. What are my options? Am I better off taking the layoff now and claiming unemployment so I can devote all my time to looking for another job?
