Legal Question in Employment Law in California

disclosing a juvenile record on an application

My question relates partly to employment law and

criminal law.

Recently, I was asked to fill out a job application and it

asked if I had ever been charged, fined, or served

probabtion for breaking the law in some way. I had a

minor juvenille violation that I was given 6 month

probation for. We sealed my record when I turned 18. I

answered the question ''no'' on the application.

My question is, when they do their authorized

background check with a Consumer Reporting Agency

(CRA) will my juvenille record show anything or is it as

good never having a record?

Thank you in advance for your time.

It should not show up, although if you are applying with a state or federal entity they may seek to have the records unsealed but it can only be done so by court order. I hope the job works out well for you-Martin

Re: disclosing a juvenile record on an application

-Labor Code sec. 432.7 prevents employers from asking about arrest records or participation in, any pretrial or post-trial diversion program. So the question itself may be improper. Your sealed record will likely not be discovered.
