Legal Question in Employment Law in California

Discrimination at work

My husband works as an installer for the same company as his brother. His brother is a project coordinator. The company will not allow my husband to transfer to the office where his brother works because they are related by blood. They said that since he will be working under his brother, they will not allow it. Is this legal?

Re: Discrimination at work

This issue comes up more often as it relates to married couples. The courts have decided that an employer's interest in maintaining an orderly workplace outweigh what ever interest employee may have in working with a spouse. More than likely, not allowing your husband to work with his brother would be upheld as a reasonable rule by the employer to avoid an appearance of impropriety.
