Legal Question in Employment Law in California

Discrimminated against after Workmans Comp Claim

I was an employee of a california university for 25 years. I l took stress leave, filed workmans comp & won. When I tried to go back to work in a job I had done for 10 years, I was denied my job and was told I would be demoted. I took an early retirement out of duress. I retired effective November 1, 2008. Do I have any recourse action?

Re: Discrimminated against after Workmans Comp Claim

Without knowing the position of the university, this sounds like a possible disability discrimination claim and retaliation for asserting your workers compensation rights. This along with a long career at the school, makes it possible that you have a legitimate and strong discrimination claim. Of course, more facts are needed to determine that.

Thanks, and feel free to follow up.
