Legal Question in Employment Law in California
DLSE unpaid wages hearing
I worked more than 2 months full time on 7 days. On the weekend, I would hold open houses and during the week, I was a general laborer and let in subcontractors etc. i also stayed at the 2 building sites in CA 92240 DHS, Riverside county.
Payment: $ 320 cash plus a $ 1,000 check. Employers are builder husband and his realtor wife.
First, I filed a claim against the general contractor's bond. He invented a company name and responded, I never worked for ''''P. Construction''. Correct - but they hired me as individuals and their company had a different name and still exists under that old name.
Q: Can I expect to get compensated for representation? Do I have to attend the hearing, as I am overseas right now? There are many witnesses as I lived and worked there for MONTHS. ** The latest trick is the builder now claims I was working as ''a real estate investor''. ** Once a few questions are asked, under oath, I trust he will give up lying and just pay up.
Work done: water irrigating, gardening, cleaning building sites, guarding, letting in subs, selling 2 homes... Helping as a gopher with whatever needed to be done. Like fetching white goods.

Re: DLSE unpaid wages hearing
you do need to attend the hearing -- alternatively, you can drop the action before the labor commissioner and sue him in civil court -- as far as your belief that he will stop lying and just pay up -- you're a very trusting optimist. . . sounds like he's more interested in keeping his money, whether or not he's under oath.
