I have a case before the merit system protection board.(MSPB) The judge has not ruled on jurisdiction. The agency is arguing that MSPB lacks jurisdiction. The agency does not want the case to go for hearing. the agency's argument is on jurisdiction, not on the merits of the case. Are there any cases that can be filed on the lack of Due process. Which court has jurisdiction? Federal case laws on agency lack of due process would be helpful. The agency says that the employee pending disciplinary actions. The incident occured over four years. the agency lacks a NEXUS. But the agency refuses to promote or transfer the employee and will not put anything in writing.
