Eavesdropping Utilizing Cell Phone

A personal cell phone accidentally speed dials a supervisor without the employee's knowledge. The supervisor answers the phone and hears the employee's conversation with others in the car. Supervisor uses info against employee who ends up being terminated. Isn't this invasion of privacy?
