Legal Question in Employment Law in California

effective termination date

Is the effective termination date when the employer first notifies you verbally or in writing or on a date they allegedly decide to terminate employment? Does the date of ones final pay determine the effective termination date?

Re: effective termination date

Your last date of employment is termination date and, if he/she terminates you, the law requires he pays you all monies owed to you, on that date.

Re: effective termination date

The effective date of termination has been held by the courts to be the last day worked, unless the employee is suspended prior to termination. The date of the notice is not necessarily the effective date, if given in advance of the last day of work.
