Legal Question in Employment Law in California

employee rights

I gave notice on 10/26/00. I agreed to stay until 12/15/00. After giving notice, the person I worked for did not want me to stay, so the office manager decided I would float until 12/15/00. On 10/30/00, I began working for two people. On 11/09, they both decided they wanted another secretary but not until 11/13. Their reason was ''I had made changes to a document.'' The document had been given to me to make revisions. I changed some grammatical errors and omitted defining terms. I was told never to make changes to his documents unless told. I said I would delete the changes, but he said that was OK. Later, I looked at the document and saw he had kept most changes. On 11/10, the other person began to harrass me by telling me what to do, what order to do it in, rearranging my work order, and hovering around my desk. Finally I said, ''if I had any questions, I would ask;'' he exclaimed ''that was it, I was gone.'' The office manager said I should leave that day. Am I entitled to the promised wages due to me if I had continued my employment until the agreed upon termination date 12/15/00?

Re: employee rights

I think it is probably worth a try to go to small Claims Court and ask for the wages. Generally, they can ask you to leave it anytime. However, if they asked you to stay to a certain date and and you agreed to do that, I would argue that you have a contract of employment for a specified period of time and that they breach that contract. However, your damages would be reduced by whatever money you earned during that time at a different job.
