Legal Question in Employment Law in California

Employee's rights re: housing (rent) and utilities paid by employer instead of s

My husband and I have been on-site managers at a resort for 1-1/2 years and have our rent and utilities paid by our employer instead of receiving a salary. The problem is that during this time he has been increasing our responsibilities and duties without fairly matching with reasonable wages. We do have an ageement as to some extra bookeeping work that I do however he keeps changing the rules or makes up new ones as we go along. We feel as though we are being taken advantage of and that he is trying to get the most out of us that he can! Help!

Since you are probably are at-will employees with no contract setting forth your duties or limits on the employer's right to ask for more work, you can either accept the new duties and try to negotiate more money, or, if the employer refuses, you can quit and try to get work that more fairly compensates you for your time and effort.

California law requires that you be paid at least the minimum wage for each hour you work. In addition, there are limits as to the amount of rent an employer may credit toward the minimum wage. You should review your entire compensation arrangement with an experianced attorney to determine whether you have a claim for unpaid wages.
