Legal Question in Employment Law in California
Employer Blacklisting
I recently turned down an employment offer from a fairly large mortgage bank located in Irvine, CA. I wasn't really comfortable with the conduct of the Mortgage Bank's internal recruiter, so I decided against working for them. I decided to work for a larger, more reputable mortgage bank.
Since that time, I have received numerous emails from the recruiter stating that he ''...knows a lot of people in mortgage banking...'', and that I'd ''...better not quit my job anytime soon''. The emails have all been sent from the mortgage bank.
The subject heading in his last two emails were ''We know you are at 'XYZ Mortage''' (my new employer). I don't know what that is supposed to mean, but it is certainly not comforting. Is there anything I can do to stop this blacklisting? I never even worked for the company! Also, does the mortgage bank that employs him as a recruiter have any liability?

Re: Employer Blacklisting
You may have a case against the recruiter. at first blush it would certainly appear so. If you do not want to consider persuing sue this person and their employer, then I suggest you initiate communications with the recruiters employer to have these threats stopped. As Ms Ghosh has alluded to, the recruiter may be guilty of any number of intentional torts-wrongs for which you may collect damage awards/money-and his/her employer may also be liable in tort as well. Feel free to contact me if you need to explore further-Martin
