You will need to have an employment law attorney review your contract before anyone can advise you on the merits of filing a lawsuit. There are many factors which would go into, not the least of which is the amount of damages you are seeking. Lawsuits are much more expensive to pursue than are wage claims through the DLSE. However, if the damages are large enough to make it worthwhile, you could file a breach of contract cause of action in court.
