Employer Right to discipline Supervisor
May an employer discipline a supervisor who sues an employee in small claims court for filing a police report against the supervisor for an alleged assault? The supervisor was the supervisor of record for the employee but has recently transferred to another dept and been promoted. The employee being sued is one of three employees who reported to the Supervisor who claimed that the supervisor was physically intimating them. One of the Employees being sued is due to give birth at about the time of the small claims court hearing and she along with the other three were advised by their Manager of their rights under the organizations Zero Tolerance for Violence Policy to file a police reportand she must withdraw her suit and that the employees were exercising their rights as employees.
