Can Employer Tell Someone Former Employee Did Horrible Work?

Can ''Jamie'' sue?

Jamie's employer told Jamie's customer (not related to the job) that Jamie did awful work, was extremely difficult to work with, and was possibly disturbed.

The discussion came about because the customer called the employer looking for Jamie who was doing the customer harm. Both parties started talking and discovered they were both victims of Jamie's acts. The employer said they were about to terminate Jamie, which they did. Shortly thereafter, the employer called the customer and told them malicious acts that were committed as revenge by Jamie because of the termination.

Can Jamie sue the employer for his comments? Neither employer or customer have discussed this with anyone else but it may come up in a lawsuit by the customer against Jamie because of revengeful acts and damages.

Can Jamie sue the employer for sharing his experiences about Jamie?

Of course, Jamie could sue for any reason. Whether Jamie could prevail at trial or survive summary judgment is an open question.
