Legal Question in Employment Law in California

Employer placing a cap on commissions

My employer has asked me to sign an employment contract that gives me a draw against commissions rather than a salary, but places a cap on the amount of commissions I can earn in a year. If I reach the cap before the end of the year, can I be forced to continue selling without benefit of being paid even though my employer will receive full benefit of my work and financial production?

Re: Employer placing a cap on commissions

You should consult with an employment attorney for a full review of the proposed agreement. It is impossible to advise you without such a review.
