Employer refused to pay commissions after resignation

I'm a H1B visa holder, recently I left my previous employer for another company. On the last day with my previous employer, they refused to pay my commissions (about $5000) which was owed to me since last year. I don't have a formal contract about the commission policy but I do have emails which my boss agreed to pay accoridng to the plan. I have requested for a formal contract but he mentioned in the email that it's the official agreement. How can I claim my commissions?

File a claim with the State Labor Commissioner at the local office of the Department of Industrial Relations, Division of Labor Standards Enforcement. You may be entitled to a penalty for the failure to pay on time.
