Legal Question in Employment Law in California

HELP - My employer is refusing to pay the salary for hours worked.

My previous employer (NJ based computer consulting company) has refused to pay me the salary for the hours worked.

I am a computer engineer. I was doing contracting for my previous company, I was being paid a salary of $60k per annum, while they were charging $99 per hour for me from the clients. I worked for them for around 7 months.

When my contract ended at clients location, I resigned from the job and joined a big software gaint. They still have my 3 weeks of salary with them. They have refused to pay me that. what can i do ??? I was working all these three weeks and they billed for me too.

They say they incurred travelling in sending me to California (for their contract) and other expenses. I had never ever signed any agreement or document saying that they can deduct it from my salary when i leave.

You have the option of filing a wage claim with the California Labor Commissioner or filing a lawsuit. If the wages due are less than $5,000, you can file in small claims court. Employers cannot deduct expenses from your paycheck, with or without a contract. In addition, the employer may be subject to waiting time penalties in the amount of a day's pay for every day they are late, up to a maximum of 30 days. You should see a labor law attorney near where you live to help you.
