Legal Question in Employment Law in California
employer retaliation and harrassment
My employer had given me a final
written warning, my first and only
written warning or disciplinary action
ever, for being ''dishonest during an
HR interview'' involving another
coworker.
Now she is suspending me for
making a mistake in documentation.
(I'm a nurse) That she admits was an
honest mistake. And it didn't harm
the patient in any way. There is
obviously more to the story,
however, I feel she is using me as a
scapegoat and the punishment is not
fitting the crime because everyone
makes mistakes.

Re: employer retaliation and harrassment
Hello.
Being a scapesgoat is wrong and unfair but generally not illegal, unless the reason for supervisor's targeting is discriminatory (due to your race, sex, disability, religion) or retaliatory, or if you are terminated in violation to an express agreement (such as the union agreement).
Feel free to follow up.
