Legal Question in Employment Law in California

Employment Agreement

I am part of a small employee bargaining group which is part of a City government. In September of last year our group's president signed the Memorandum of Understanding after he was told by the City Manger who was the City's negotiator for all four bargaining groups that all of the groups were receiving exactly the same thing. However a week later we found out that another group received 100 hours more of administrative leave and were able to cash it out at any time thorougout the year. Our president would not have signed our agreement had we know that the other group was going to get this added benefit. The City Managers benefits are also tied to this other groups benefits and we now feel that he bargained in bad faith and deceived our group into believing that everything was equal when in fact it was not. I will be leaving employment with this city in a few days and even now negotiations are going on but the city is refusing to negotiate this issue. What can I do that would benefit the entire group? Can I file a lawsuit?

Re: Employment Agreement

The union can sue over the deception. . . you might also be able to file a claim for unfair labor practices with the NLRB - I don't think that you can sue individually, because your union represents you. . . but I'm not certain on the issue.
