Legal Question in Employment Law in California

We have an employee who has suffered a work related injury and we are unable to provide reasonable accomodation. Currently the employee is performing alternate work as part of an RU-94 agreement.

Are there any exceptions under FEHA or ADA that allowe an employer to terminate an employee withouth fear of disability descrimination law suite?
