"if you are driving (i.e. to san diego) to do a hearing and you leave a 5:00 am to arrive at hearing on time, are you in the course and scope of your employment, and are you considered working at this time?" thank you

Probably. I will assume that the hearing you are attending is part of your job. Next, I will assume that your regular work location is someplace other than the location of the hearing, or in the alternative, part of your job includes driving to other hearing locations. Under such circumstance, because you must as a condition of employment travel from one work location to the next, you will be considered to be within the course and scope of your employment. The time, in advance of the scheduled hearing that you elect to leave your home, does not change the situation
