Legal Question in Employment Law in California

Employment Termination without Notice.

Hi

My question is I am working on H1 visa for a consulting company . Due to the ecomomic slowdown I am out of my contract.

My employer is laying me off. But when i asked him what happens to 1 month notice as written in my offer letter , he say I gave u a verbal notice and that is enough and u dont have to come from coming weeked.

Can an employer do so , when the offer letter states an 1 month notice from either side ?

Also he has reduced my salary ,stating that economic is not doing so . Can he legally do so without a written notice ?

Please advice ?

thanks

Re: Employment Termination without Notice.

No advance notice of termination is required by law unless it is agreed to in a contract. Then, the terms of the contract will rule. If the notice must be in writing, and the employer failed to give it to you, you are owed 30 days pay and should take him to small claims court. Wages may be raised or lowered, unless the contract guarantees a wage rate for a specified period of time.
