employment testing

Can private Northern California hospitals test potential employees for drug and HIV status? Can a potential employee not be hired because they tested positive on either test? What cases or laws are the answers based on?

This area of the law is in flux and could change at any time but right now private employers can drug test any applicant or even current employee. And they can refuse to hire for not passing the test.
