Legal Question in Employment Law in California

Enforcement of policies

My wife and I work for the same ambulance company. We were recently issued a

new policy manual, inside was a policy that stated, no family member can supervise another, directly or indirectly. I am a supervisor and she is not. My problem is, this has been in policy for over 2 years and has been overlooked for that time. Can the company now enforce that policy, even though it has been overlooked for such a long time? The book also states that one will have to resign and if neither can decide, then both will be terminated. What would be considered a adequate length of time to make the arrangments for one to leave? There is also a related subject that no family member can work on the same ambulance together, once again this is already policy and has been overlooked. Thanks for the help.
