Legal Question in Employment Law in California

I am exempt employee working consistently over 40 hours per week for the last 4 years.

I inquired about my vacation time available a found out that I was charged vacation time for two sick days I occurred over the last six months.

Is it legal for my employer to do this without my consent? As an exempt employee do I get some kind of compensation for sick time?

There is no requirement that your employer give you sick or vacation time whether you are exempt or not. Exempt has to do with whether you are salary or hourly and overtime issues, not sick or vacation time. If it is your companies policy to give sick time and they did not issue it then you need to take it up with the labor board.
