Legal Question in Employment Law in California

Eye disability affecting ability to work

My sister's left eye was injured by her young son accidentally at home a few years ago. She can still use that eye but it gets tired very easily and her vision is decreasing. She's a teacher and says that due to her teaching activities in the classroom, she constantly gets headaches and discomfort while in the classroom because of the deteriorating eye. She wants to quit teaching. My question is, can she get any type of work-related compensation for this if she does quit. Alternatively, is there any type of help from the State?

Thanks.

Re: Eye disability affecting ability to work

Your sister's original injury was not work-related, however, it seems that the aggravation of her condition is work-related. Therefore, she is covered under worker's compensation laws. I suggest that she reports her injuries to her employer and then retain an attorney and later through her attorney she should request for a panel Qualified Medical Examiner or an Agreed medical examiner who can determine to what extent her condition was aggravated. please call us at 213.388.7070 if you need representation or for a free consultation.
