Failed psychological evaluation due to a juvenile offense, a minor in consumptio

I am wonding if it is illegal to not hire someone based solely on a juvenile offense. My husband was rejected employment by the California Department of Corrections because of a juvenile offense. He failed his psychological evaluation because he had two Minor in Consuption violations before the age of 18. The psychological evaluator felt these tickets reflected a drinking problem and failed him. I thought that a juvenile offense is supposed to expunged from a criminal record and can no longer be held against us. Was is illegal for the California Department of Corrections to not hire my husband because of a juvenile history?
