Legal Question in Employment Law in California

Failure to pay wages upon termination

My employer, a newspaper, didn't pay me, a reporter, for vacation upon terminating me. They said to appeal to the bankruptcy court.--But I learned that the same day they terminated me, they emerged from BK!

So I wrote them requesting my pay. I also requested overtime pay and listed the hours. They had been aware of it but weren't documenting it (telling me I was exempt) and I had feared pushing the issue would cost me my job.-My supervisor had told me "in news OT isn't paid -deal with it.") (another editor had told me he would give me time off to make up for all my extra hours--but he resigned before that happened.)

I've filed w/ the Labor Commission. Do I need an attorney? What's enough proof of hours worked (news stories)? I expect my employer to lie.

Re: Failure to pay wages upon termination

I dont think you need an attorney at this point. The Labor commissioner is pretty good at getting people paid.
