Legal Question in Employment Law in California

I fell through the cracks...

Here is the situation:

I was promoted out of a dept. After my paperwork left the dept. those dept employees received a 20% raise and a $5k bonus. The dept I was promoted into received the same raise and bonus, before my paperwork was finalized. So, I am effectively making 20% less than I would be if I had not accepted my most recent promotion. Do I have a case? There are 5 people with my same job title, we are all in the same situation.

Re: I fell through the cracks...

A case to do what? Did the company enter into a contract with you for the pay raise? Have they discriminated against you for an improper reason? If so, maybe you have a case. We'd need to explore that further. But if you simply fell through the facts, would you jeopardize your job by looking to sue them? Talk to the person you believe could help you the most. A manager who helped you get the promotion, or a Human Resource person you think may be sympathetic, and describe the situation. If this is a company that treats its employees fairly, they will work with you. If it's not, maybe you should reevaluate whether this is the company you want to work for.
