Legal Question in Employment Law in California
fired after attack
I worked as a nurse's assistant in a convalescent hospital. I was attending to a patient when a psychiatric patient (who was supposed to be in isolation) who was covered in blood came into my room and began to assault me and my patient. Other nurses rushed into the room to take the assailant out of the room. After, I complained to the charge nurse, stating that this patient should not have been allowed to wander into other patient's room given his history of violent behavior and contagious condition. He later went outside into the parking lot and injured himself badly; he was transferred to another facility shortly after the incident. I was fired the following week; the reason for termination given by the Director of Nursing was that after the attack, I was observed ''rushing down the hall shouting a patient's diagnosis and his danger of infecting and attacking others. This behavior agitated other patients and is a violation of patient's right to privacy and breeched confidentiality.'' Was it legal for the hospital to terminate me?

Re: fired after attack
Unless your job is protected by a union contract or you are a civil servant, most likely, the employer can terminate your employment at their will.
