Legal Question in Employment Law in California

Fired By A Kid!

I was recently employed by a small movie theater in Ca. i was hired by the owner (we'll call him Matt). since my first day i was picked on by one of the managers (we'll call him andy) the owners wife (also a manager) made it very clear that she didn't like me either. on sunday i asked stan (the owners' 17 year old son also a manager) why andy & his mother didn't like me. he said ''there is no real reason for it, you just clash.'' i asked how i can fix it. he said i can't. it's just a matter of time before i quit or get fired. my shift was over so i went home, two hours later, stan calls me & says ''sorry it's not working out, you can pick up your last check on weds''

is termination over the phone legal in California?

Doesn't the employer only have 48 hours to give the final check?

oh & andy's wife works with my mother in law, & my mother in law found out about my termination through her!!! isn't that illegal as well?

what can/should i do?

Re: Fired By A Kid!

An employer can fire an at-will employee for any reason but cannot fire you for an illegal reason like age, race, etc. It doesnt appear based on the facts that you have supplied that the termination was unlawful. However, you may wish to consult a local employment lawyer. Upon termination, your employer must provide you with your lat paycheck, which must include all earned wages and earned vacation. If you didnt receive your last paycheck on the date of termination you may be able to file a claim with the labor board.

Good Luck!
