Fired for being sick

I recently came down with a severe case of bronchidus and informed my work i was on the way to the hospital because i was sick. I was seen and given a perscription not to work for two days by the doctor. I informed work and was contacted the next day and told i need not come to work any longer because my shifts were covered and to pick up my ncheck on friday. Can they do that? Dont they have to pay me right away?

Re: Fired for being sick

Most likely, your employer owes you your wages and waiting time penalties. Generally, employers must pay terminated employees immediately. Certain types of employees (seasonal, motion picture) need not be paid for up to 72 hours. Demand your pay.

More importantly, your employer cannot terminate you due to illness. For further assistance in this area, any attorney will need to know 1) the type of employment, 2) the length of employment, 3) union or non-union, 4) rate of pay, 5) written employment agreements, if any.
