Flexible hours do not seem fair

I work in a small insurance company ( 30 employees) that offers 'flexible hours'. It turns out that those employees that have children at home are allowed to work 4-6 hours a day and come and go to accommodate their children. Those of us with no small children are expected to work 8 hours a day but our hours are 'flexible' (i.e 7-4, 8-5, 9-6) I specifically asked my boss if I could come in at 10:30 A.M., work for an hour, take a 1.5 hour lunch and leave at 4:30. He indicated that I could not as those that have those hours have children at home and my children are grown. Incidentally, their pay is substanially more than mine and there are no deductions made for working fewer hours. This hardly seems fair - is it??

Fair...no. Legal...yes. There is no such thing as discrimination based on not have young children.
