Legal Question in Employment Law in California
Forced pay forfeiture without merit
Hello,
I am a business acquisition officer for a large bank in San Francisco. I sold bank products to a business client in May who is apparently now the subject of a money laundering and fraud investigation. Due to this investigation my company has determined that I am not entitled to my quarterly incentive pay of approximately $45,000 and put me on six months of probation. I feel that I am being scape-goated for this investigation, even before it has been completed. I have been repremanded for offences that are without merit and have been given punishment that is excessive and not befitting those infractions. I followed company policy and procedure in bringing the client to the bank and have tried to convey that to my HR and management team to no avail. They have asked me to sign a formal written warning containing reasons for corrective action that I strongly disagree with and should not be held accountable for.
I cannot seem to find an advocate within my company to help me appeal this repremand. At this point, I feel I need legal council to assist me in making progress. Please contat me if you can help.
Thank you,
Joe
