Legal Question in Employment Law in California
Forced paycut or quit?
I'm a manager, i make 11.00 an hour. Business is horrible, owner says he can't afford to pay me. I can quit, or take a 4.00 pay cut. That makes me uneligible for unemployment. I was told on 1/16/02 that this would take effect as of 1/21/02. I have a one year old daughter and cannot afford to lose my job or a paycut. Can he do that? Is there any way to get unemployment until i find a job? Don't i need more notice?

A manager who makes $7.00 an hour is not a manager when it comes to being exempt from overtime pay. If you have been paid on a salary basis, instead of hourly, your rights are being violated. State law requires that you be paid two times the minimum wage rate to be exempt from overtime. Check your hours and method of pay. You may be owed some money.
