Legal Question in Employment Law in California

Freedom Of Expression

I work for a small private business, and a woman dyed her hair in a very subtle way (one streak of red). The office manager told her if she didn't dye it back she would lose her job.

Has there been any cases where freedom of expression has covered this type of situation in a private business?

This is tough issue. If the employer can't specify a job related reason for the direction, it may not be permissable. However, what is job related is a question of fact, and very much subject to the nature of the employer's business.
