Legal Question in Employment Law in California

I have a friend in So. Cal. who is looking for office work. She said there are a few jobs but at least one wants people to work 10 hours free and then start to get paid. Is that legal?? Thanks, Gary

Of course not. All hours of work must be paid for at no less than minimum wage. Tell your friend to stay clear of this employer.

Many people are desparate for work these days and this employer will have lots of people willing to give him 10 hrs free labor. But the employer is opening himself up to a a lawsuit by anyone who worked for free. Although it is only 10 hours, and perhaps not worth the effort for a single employee and/or an attorney, all those who were taken advantrage of could file one lawsuit together. If 40 or more people have been taken advantage of, there could be a class action lawsuit. Also, an employer who is doing this is probably violating other labor laws as well. Not the type of employer you want to work for.
