garnishment of tips

Waitpersons at a restaurant have been told that the owners will be withholding 2.5% of their charge card tips. This is supposed to help the owners cover the expense of people using charge cards. Is this legal? If not, to whom could they complain? The employees feel charge card company costs should be a cost of doing business and not something the employees should have to pay.

You should file a claim with your local office of the State Labor Commissioner for any tips that your employer withheld from you to cover business expenses or losses.
