Legal Question in Employment Law in California
do I have to give sick days to full time employees
2 Answers from Attorneys
Paid sick days are not required by law. But, under certain circumstances medical leave laws may apply, such as disability leave, family leave and workers compensation leave. If you are an employer and you do not know about these laws, you most certainly need to educate yourself about your responsibilities as an employer to avoid a potential costly lawsuit. There are many seminars available, government programs, or you can simply consult with an attorney who advises employers on labor laws in California.
Mr. Kirschbaum is correct. You may have to give sick time off, but there is no requirement that you pay for the time off. The only exception I know of is San Francisco, which has a local mandatory paid sick time law.
