Legal Question in Employment Law in California

H1B visa : employer not honoring employment offer

I had an offer with company B in Nov 2000. Company filed for a new H-1B visa petition in December 2000,while I left for India because my earlier employer A had layoffs.I waited for 4-5 months in India to have my H-1B approved petition sent to me.It did so,and I also got my visa stamped and came to the US on 5th may 2001.My start date with company B was supposed to be 21st May. Now company B is saying that it can not let me join it and also asking me to sign a Release agreement. What legal action can be taken in this situation and to preserve my legal status?
