Legal Question in Employment Law in California

Hi,

I have requested my previous employer based in California to provide me an experience letter for the duration of my association with them, including the technical duties and skills in it. But the employer is reluctant to provide such a letter.

I need that letter for paperwork of I-140 immigrant worker petition.

Please tell me if there is a California State law or federal law by which the employer is obliged to provide me this letter ? This was also not a part of any agreements with the employer.

An employer does not have to provide such information and there is no law that would force them to do so. Many employers are reluctant to provide such documentation for fear of being sued or inviting government investigation. There may be some alternative way to accomplish the same thing. Talk to an immigration attorney.
