Hiring Volunteers

I work for a non-profit organization and we often hire volunteers to work with all ages of kids. When asking on the application about prior convictions, are we held to the same restrictions as those who hire employees for-profit? For example, am I allowed to ask a potential volunteer who will work with high school students if he or she has ever been accused or convicted of a crime involving a minor?
