Hostile Work Environment question

My son works in a family-run restaurant. One of the waitresses (unrelated to the owner) is an outspoken woman of muslim faith. She is a confrontational person. She has been harassing my son regarding her beliefs and trying to upset him. This is an ongoing problem with her. She is a supporter of Saddam Hussein and is upset he was caught. In front of other employees she said the people in New York ''deserved what they got.'' She told my son he doesn't know the world and he is just a kid, etc. and she shakes her finger at him. He is married with a family. Does my son have any legal recourse? What do you recommend?

If your son believes that he is being harassed because of religion and/or national origin, he should speak privately with the owner and express his concerns. The owner then will be on notice to do something to keep the waitress from spouting off because of those characteristics.

If the conduct continues after complaining, you son may have a claim for Harassment. He should consult with an expierenced employment attorney for specific advice.
