Legal Question in Employment Law in California
Hostile workplace caused my resignation, now I cannot get rehired, why?
I am the General Manager at a hotel, and I had a private meeting with my housekeeping staff about the ''wrong doings'' of the Executive Housekeeper. She found out we held a meeting about her and threatened to get us fired. She began threatening us by saying, ''Don't mess with her because she is a scorpion, and will bite.'' I asked upper management for help/investigation, due to my inexperience in this area. I never received any; each visit by upper management was cancelled. After 2 weeks of threats, suspected loosen of bolts on employee's vehicle, internal sabotage and her brother threatened and called police on myself...I decided to resign due to fearing my safety and attacks on my character. The next day, upper management finally stepped in and investigated. She was terminated 2 days after my resignation. 2 weeks later my staff keep begging for my return, and I decided it was safe to return, I called the management company and my response was, since I quit there is a no-rehire policy. Is this right? Even if I left for my personal safety due to a disgruntled employee. I kept a journal of all phone calls, emails, weekly reports and conversations with upper management requesting assistance and my worries.

Your were constructively terminated because a reasonable person in your position would have quit. While this may give rise toa cause of action for wrongful termination, I need more information. Please call me directly at (619) 222-3504.
