Legal Question in Employment Law in California
human resource department violations
Who can you go to when a company's human resource department director is corrupt, unethical, and has sexually harrassed employees? Any employee should be able to go to their HR department with any problem, but not this company. Going to higher management is not an option because they do not see any problem with the HR director. Even when reporting sexual harrassment from other employees, the HR director only does a cursory investigation and counsels the accused employee. Are the employees protected by a law?

Re: human resource department violations
The employees are protected by the Fair Employment and Housing Act (FEHA). But this is a complicated situation. One can make a complaint to the CA Dept. of Fair Employment and Housing (DFEH) but there is a danger that anyone who does so will be fired in return. The person who gets fired may then have a claim for retaliation, which is also prohibited by the FEHA, but that may be of little comfort to the person who is out on the street without a job. More than that I cannot say. If anyone is fired who complains and the company is located in Los Angeles County, contact my office if the person wishes the situation to be reviewed.
