Got hurt while working under the table

I was doing some painting for a guy I have worked for in the past and got hurt after I fell off a ladder. He always pays me in cash and has me do odd jobs for him at his house. He tells me what to do and was working with me when this happened. I also believe that he was negligent because I got hurt due to his bad decision and placement of the ladder. I broke my hand and cannot work or play my instrument anymore. What are my rights? What causes of action if any can I claim? What is my case worth? Should I approach him without an attorney? What defenses are he likely to raise?
