Legal Question in Employment Law in California

Hybrid Employee?

Here are the facts:

Hired as temp to perm, 3 month contract extended to 18 months.

CEO promised full time position which never happened.

Put in many overtime hours (was paid hourly) when I tried to put in overtime hours was told I was managemnt. But, person I hired for assistant was made manager without my knowledge and was paid overtime. I asked why she was given overtime and was told I make too much money.

Corporation gave me a corporate AMEX card with my name and I owe $36000. Will effect my credit rating and future employment so I have to borrow money from my husband's 401k.

Termination without a valid reason. I was just told it wasn't working out

Not given any benefits

My next step is to find a lawyer that will help me recover lost wages, overtime, benefits like a 401k and pay the Amex card.

Anybody willing to take on this case?

Re: Hybrid Employee?

You may have a claim for unpaid overtime. In addition, if you were terminated because you made a demand for overtime to which you were entitled, you may have a claim for wrongful termination in violation of public policy. The claim for unpaid overtime may be pursued through the Labor Commissioner. In order to evaluate whether I can "take your case" I would need to know a lot more about it.
