Legal Question in Employment Law in California

Illegal Deductions; Incorrect Wage Statement totals; etc..

Am wondering what to do if your previous employer reported incorrect year end wage statement totals based upon illegal deductions that were made by the employer...

I have requested that the former employer correct the years that need to be ammended=because 2 of the 4 years they reported my earnings incorrect, did put me in a different tax bracket..

They refuse to acknowledge the request to correct the error(s)..or is it up to me and the IRS to figure this out?

thank you for your help

Perhaps having counsel to handle the interaction with your employer would help. Nevertheless, I am interested in hearing more about the deductions your employer is making illegally. You may contact us at (510) 891-9800 to discuss further.

The California Employment Development Department has a division that investigate employers who incorrectly report the earnings of employees. If an audit reveals they are providing false information to the State, they can be hit with stiff penalties and have to correct the wage for you. Contact EDD and explain your situation to them.
